The Balearic &#8220;building amnesty&#8221; (officially: the extraordinary legalisation procedure under <em>Decreto-ley 3\/2024<\/em>) is the one chance for many finca owners to turn illegal extensions, pools or entire buildings into fully documented, legal property. If you are <strong>buying a finca<\/strong>, this deadline should be part of your due diligence.<\/p>\n<h2>What is the building amnesty?<\/h2>\n<p>In May 2024, the Balearic government created an extraordinary legalisation procedure. It allows buildings, extensions and installations on <strong>rustic land<\/strong> that were built without (or beyond) a licence to be legalised \u2013 provided the administration can no longer order demolition because the infringement is <strong>time-barred<\/strong>. &#8220;Tolerated but illegal&#8221; becomes &#8220;legal with full paperwork&#8221;.<\/p>\n<p><strong>The clock is ticking:<\/strong> applications are only possible for three years from the publication of each island council&#8217;s implementing decision \u2013 for Mallorca the window closes in <strong>mid-2027<\/strong>.<\/p>\n<h2>Which properties qualify?<\/h2>\n<ul>\n<li>Buildings on <strong>suelo r\u00fastico<\/strong> that are <em>fuera de ordenaci\u00f3n<\/em> (non-compliant with current planning law)<\/li>\n<li>The administration&#8217;s right to demand restoration is <strong>already time-barred<\/strong> (for pre-2018 buildings: usually 8 years after completion)<\/li>\n<li><strong>Protected land<\/strong> (nature reserves etc.) is subject to exclusions or special rules \u2013 case-by-case checking is essential<\/li>\n<\/ul>\n<p><strong>Key point for buyers:<\/strong> buildings erected <strong>after 2018<\/strong> on rustic land never become time-barred \u2013 for those, the amnesty is usually the only path to legality, if they qualify at all.<\/p>\n<h2>What does legalisation cost?<\/h2>\n<ul>\n<li><strong>Compensation levy (prestaci\u00f3n econ\u00f3mica):<\/strong> staggered by application year \u2013 10% of the construction value in year one, 12.5% in year two, <strong>15% in year three<\/strong>. Applications filed now already pay the top rate. Reductions exist for lower-income owners.<\/li>\n<li><strong>The usual taxes and fees<\/strong> as for a new build (construction tax ICIO, administrative fees)<\/li>\n<li><strong>A technical project:<\/strong> an architect or aparejador must prepare the legalisation project \u2013 typically several thousand euros<\/li>\n<\/ul>\n<p><strong>Example:<\/strong> an unauthorised 80 m\u00b2 extension with a build value of \u20ac1,200\/m\u00b2 (= \u20ac96,000) currently costs about <strong>\u20ac14,400 in levy<\/strong>, plus taxes, fees and the project \u2013 realistically \u20ac20,000\u201325,000 in total. A lot of money, but often a fraction of the value a fully legal property gains at sale.<\/p>\n<h2>The conditions: environmental upgrades are mandatory<\/h2>\n<p>The legalisation project must include measures that improve the building environmentally \u2013 for example reduced light pollution, better energy or water efficiency (<strong>solar panels<\/strong>, rainwater tanks) and a <strong>proper wastewater solution<\/strong> compliant with the Balearic water plan (an old soakaway will not do).<\/p>\n<h2>What this means if you are buying<\/h2>\n<p>A seller&#8217;s &#8220;everything is fine, it&#8217;s all time-barred&#8221; is not due diligence. Before you sign anything:<\/p>\n<ul>\n<li>Check what is actually registered (nota simple) and what physically exists \u2013 differences are the norm, not the exception<\/li>\n<li>Ask whether the property qualifies for the amnesty and <strong>who pays for it<\/strong> \u2013 a \u20ac20,000 legalisation is a negotiating point<\/li>\n<li>After mid-2027, an unlegalised building stays <em>fuera de ordenaci\u00f3n<\/em> forever: no extensions, harder financing, lower resale value<\/li>\n<\/ul>\n<h2>FAQ<\/h2>\n<h3>How long can applications be filed?<\/h3>\n<p>For Mallorca the three-year window ends in mid-2027.
