1. Scope and Operator
These terms govern the relationship between the operator of mallorca-portal.com (the “Operator”; details in the Legal Notice) and the users of the platform. By registering or using the services, you accept these terms.
2. Description of Services
mallorca-portal.com is a regional online marketplace and community focused on the island of Mallorca. The Operator provides only the technical platform on which users can publish listings, posts and questions. Any contract regarding offered goods or services is concluded solely between the users involved; the Operator does not become a party to it.
3. Registration and User Accounts
- Certain features (e.g. posting listings) require registration. There is no right to use the service.
- Account details must be truthful and kept up to date.
- As a rule, each person may hold only one account; creating multiple accounts to circumvent these rules is prohibited.
- Login credentials are confidential and must not be shared with third parties.
4. Principles for Listings and Posts
- Relation to Mallorca: Only content with a direct connection to the island of Mallorca is permitted (offers, wanted ads, questions and local services).
- Truthfulness and own rights: Content must be truthful. Anyone posting content confirms that they hold the rights to the texts and images used. Using third-party photos (e.g. copied from the internet or unlicensed stock photos) is not allowed.
- Automatic translation: The Operator may translate content automatically (German/Spanish/English) and optimise it for search engines. The person posting remains responsible for the accuracy of the content.
- Commercial and agent enquiries: Wanted ads from agents or commercial intermediaries – for example in the Real Estate category – are permitted, but must be clearly marked as a commercial or agent enquiry.
5. Prohibited Content and Activities
Content that violates applicable law, the rights of third parties or public decency is prohibited. In particular, the following are not allowed:
- listings unrelated to Mallorca, as well as illegal goods and services;
- commercial or agent enquiries that are not marked as such (see section 4);
- repeated identical or equivalent listings (duplicates), including across different categories or accounts;
- listings posted on behalf of third parties (proxy listings);
- pure advertising for external sites, shops, auction or directory portals, as well as listings consisting only of a link without a proper description;
- home-work schemes, network marketing/MLM, pyramid or snowball schemes, and dubious investments or loans;
- erotic or pornographic offers and content harmful to minors;
- gambling, betting, lotteries and prize competitions;
- insults, discrimination, racist statements, and public warnings or reviews about other users or companies within listing or post texts.
6. Review and Approval
All new and edited listings are reviewed before publication and become visible only after approval by the Operator. There is no right to publication.
7. Conduct in the Community
A respectful tone applies in the community areas (questions, answers, comments). Contributions should be factual and helpful. Insults, spam and advertising outside the designated areas are not permitted.
8. Rights of Use and Indemnification
By posting content, the user grants the Operator the right to make it publicly available on the platform and in connected channels (e.g. social media, app notifications). The user indemnifies the Operator against third-party claims arising from the content they post, including reasonable costs of legal defence.
9. Fees
Basic use and posting private basic listings are free of charge. Fees may apply for commercial listings and for additional services (e.g. highlighting). A paid contract is concluded only upon explicit confirmation of the paid order.
10. Liability
The Operator merely facilitates contact between users and gives no warranty as to the accuracy, completeness or timeliness of user-provided content. The respective provider is solely liable for goods and services. The Operator is liable for damages only in cases of intent or gross negligence, and for breaches of essential contractual obligations.
11. Measures in Case of Violations
In the event of violations of these terms – in particular section 5 – or where there is reasonable suspicion of misuse, the Operator is entitled to remove content without prior notice and to suspend accounts temporarily or permanently (digital house rules).
12. Final Provisions
The law of the Federal Republic of Germany applies. Should individual provisions be invalid, the validity of the remaining provisions is unaffected. The Operator may amend these terms where necessary; changes will be announced before they take effect.
